Diese Endbenutzer-Lizenzvereinbarung („Vereinbarung“) ist ein rechtsgültiger Vertrag zwischen Ihnen („Nutzer“) und Daniel Ovadia („Entwickler“, „wir“, „uns“) für die Nutzung der mobilen Anwendung ZirbelSignal („App“).
Durch das Herunterladen, Installieren oder Nutzen der App stimmen Sie dieser Vereinbarung zu. Falls Sie nicht zustimmen, nutzen Sie die App nicht.
Diese Vereinbarung besteht ausschließlich zwischen Ihnen und dem Entwickler, nicht mit Apple Inc. („Apple“). Der Entwickler, nicht Apple, ist allein verantwortlich für die App und deren Inhalte.
Der Entwickler gewährt Ihnen eine eingeschränkte, nicht-exklusive, nicht übertragbare, widerrufliche Lizenz zur Nutzung der App auf jedem Apple-Gerät, das Sie besitzen oder kontrollieren, gemäß den Apple Media Services Nutzungsbedingungen.
Die App bietet ein optionales, sich automatisch verlängerndes monatliches Abonnement („ZirbelSignal Premium“), das unbegrenzten Zugang zu allen Funktionen und Inhalten bietet.
Die App bietet eine begrenzte Anzahl kostenloser Sessions, bevor ein Premium-Abonnement für die weitere Nutzung erforderlich ist. Der Entwickler behält sich das Recht vor, die Anzahl der kostenlosen Sessions jederzeit zu ändern.
ZirbelSignal erzeugt Klangfrequenzen und bietet Wellness- und Entspannungsinhalte, darunter:
DIE APP BIETET KEINE MEDIZINISCHE BERATUNG ODER BEHANDLUNG. Die Klangfrequenzen und Inhalte der App dienen ausschließlich der Entspannung und dem allgemeinen Wohlbefinden. Sie sind nicht dazu bestimmt, Krankheiten oder Gesundheitszustände zu diagnostizieren, zu behandeln, zu heilen oder zu verhindern. Sie ersetzen keine ärztliche Diagnose, Beratung oder Behandlung. Bei gesundheitlichen Bedenken wenden Sie sich an einen qualifizierten Arzt. Bei Unwohlsein während der Nutzung beenden Sie die Anwendung sofort.
ZirbelSignal speichert alle Daten ausschließlich lokal auf Ihrem Gerät. Es gibt keine Cloud-Synchronisation, kein Tracking und keine Analyse. Die App hat keinen Zugriff auf Zahlungsdaten; die gesamte Zahlungsabwicklung erfolgt über den Apple App Store oder Google Play Store.

Alle personenbezogenen Daten werden gemäß den geltenden Datenschutzgesetzen verarbeitet, einschließlich der EU-Datenschutz-Grundverordnung (DSGVO). Alle lokal gespeicherten Daten können durch Deinstallation der App gelöscht werden.
Alle Inhalte (Audio, Texte, Grafiken, Software) sind urheberrechtlich geschützt. Sie dürfen keinen Teil der App kopieren, verändern, verbreiten, verkaufen oder vermieten.
DIE APP WIRD „WIE BESEHEN“ UND „WIE VERFÜGBAR“ OHNE JEGLICHE GEWÄHRLEISTUNG BEREITGESTELLT. IM MAXIMAL GESETZLICH ZULÄSSIGEN UMFANG SCHLIESST DER ENTWICKLER ALLE GEWÄHRLEISTUNGEN AUS, EINSCHLIESSLICH STILLSCHWEIGENDER GEWÄHRLEISTUNGEN DER MARKTGÄNGIGKEIT, EIGNUNG FÜR EINEN BESTIMMTEN ZWECK UND NICHTVERLETZUNG VON RECHTEN DRITTER.
IM MAXIMAL GESETZLICH ZULÄSSIGEN UMFANG HAFTET DER ENTWICKLER NICHT FÜR INDIREKTE, ZUFÄLLIGE, BESONDERE ODER FOLGESCHÄDEN ODER ENTGANGENE GEWINNE. DIE GESAMTHAFTUNG DES ENTWICKLERS ÜBERSTEIGT IN KEINEM FALL DEN BETRAG, DEN SIE IN DEN ZWÖLF (12) MONATEN VOR DEM ANSPRUCH FÜR DIE APP BEZAHLT HABEN.
Der Entwickler kann nach eigenem Ermessen Updates, Fehlerbehebungen und Support bereitstellen. Apple ist nicht verpflichtet, Wartungs- oder Supportleistungen für die App zu erbringen.
Der Entwickler, nicht Apple, ist verantwortlich für alle Ansprüche im Zusammenhang mit der App, einschließlich: (a) Produkthaftungsansprüche; (b) Ansprüche wegen Nichteinhaltung gesetzlicher Anforderungen; und (c) Ansprüche aus Verbraucherschutz- oder Datenschutzgesetzen.
Im Falle einer Behauptung Dritter, dass die App deren geistiges Eigentum verletzt, ist der Entwickler, nicht Apple, allein verantwortlich für die Untersuchung, Verteidigung, Beilegung und Erfüllung eines solchen Anspruchs.
Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Vereinbarung. Mit Ihrer Zustimmung hat Apple das Recht, diese Vereinbarung gegen Sie als Drittbegünstigter durchzusetzen.
Sie erklären und gewährleisten, dass (a) Sie sich nicht in einem Land befinden, das einem US-Embargo unterliegt oder als „Terrorismus unterstützend“ eingestuft ist; und (b) Sie nicht auf einer US-Verbotsliste stehen.
Diese Vereinbarung unterliegt dem Recht der Bundesrepublik Deutschland. Gerichtsstand: Karlsruhe, Deutschland. Für Verbraucher innerhalb der EU gelten zwingende Verbraucherschutzgesetze ihres Wohnsitzlandes, soweit diese einen höheren Schutz bieten.
Der Entwickler behält sich das Recht vor, diese Vereinbarung jederzeit zu ändern. Änderungen werden durch Veröffentlichung in der App oder auf der Website des Entwicklers wirksam. Die fortgesetzte Nutzung der App nach Änderungen gilt als Zustimmung.
Sollte eine Bestimmung dieser Vereinbarung unwirksam oder undurchsetzbar sein, bleiben die übrigen Bestimmungen in vollem Umfang wirksam.

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Daniel Ovadia (“Developer”, “we”, “us”) for the use of the ZirbelSignal mobile application (“App”).
By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.
This Agreement is between you and the Developer only, not with Apple Inc. (“Apple”). The Developer, not Apple, is solely responsible for the App and its content.
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
The App offers an optional auto-renewable monthly subscription (“ZirbelSignal Premium”) that provides unlimited access to all features and content.
The App provides a limited number of free sessions before a Premium subscription is required for continued use. The Developer reserves the right to change the number of free sessions at any time.
ZirbelSignal generates sound frequencies and provides wellness and relaxation content, including:
THE APP DOES NOT PROVIDE MEDICAL ADVICE OR TREATMENT. The sound frequencies and content provided by the App are intended solely for relaxation and general wellbeing purposes. They are not intended to diagnose, treat, cure, or prevent any disease or health condition. They do not replace medical diagnosis, advice, or treatment. If you have health concerns, consult a qualified healthcare professional. If you experience any discomfort while using the App, discontinue use immediately.
ZirbelSignal stores all data exclusively locally on your device. There is no cloud synchronization, no tracking, and no analytics. The App has no access to payment data; all payment processing is handled by the Apple App Store or Google Play Store.

All personal data is processed in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR). All locally stored data can be deleted by uninstalling the App.
All content (audio, texts, graphics, software) is protected by copyright. You may not copy, modify, distribute, sell, or lease any part of the App.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. IN NO EVENT SHALL THE DEVELOPER’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
The Developer may provide updates, bug fixes, and support at its sole discretion. Apple has no obligation to provide any maintenance or support services for the App.
The Developer, not Apple, is responsible for addressing any claims relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to applicable legal or regulatory requirements; and (c) claims arising under consumer protection, privacy, or similar legislation.
In the event of a third-party claim that the App infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
This Agreement shall be governed by the laws of the Federal Republic of Germany. Place of jurisdiction: Karlsruhe, Germany. For consumers within the European Union, mandatory consumer protection laws of your country of residence shall apply where they provide greater protection.
The Developer reserves the right to modify this Agreement at any time. Changes will be effective upon posting in the App or on the Developer’s website. Continued use of the App after changes constitutes acceptance of the modified Agreement.
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Ce contrat de licence utilisateur final (« Contrat ») est un accord juridique entre vous (« Utilisateur ») et Daniel Ovadia (« Développeur », « nous ») pour l’utilisation de l’application mobile ZirbelSignal (« Application »).
En téléchargeant, installant ou utilisant l’Application, vous acceptez ce Contrat. Si vous n’êtes pas d’accord, n’utilisez pas l’Application.
Ce Contrat est conclu exclusivement entre vous et le Développeur, et non avec Apple Inc. (« Apple »). Le Développeur, et non Apple, est seul responsable de l’Application et de son contenu.
Le Développeur vous accorde une licence limitée, non exclusive, non transférable et révocable pour utiliser l’Application sur tout appareil Apple que vous possédez ou contrôlez, conformément aux Conditions générales des services média Apple.
L’Application propose un abonnement mensuel optionnel à renouvellement automatique (« ZirbelSignal Premium ») offrant un accès illimité à toutes les fonctionnalités et contenus.
L’Application offre un nombre limité de sessions gratuites avant qu’un abonnement Premium ne soit requis. Le Développeur se réserve le droit de modifier le nombre de sessions gratuites à tout moment.
ZirbelSignal génère des fréquences sonores et propose du contenu de bien-être et de relaxation :
L’APPLICATION NE FOURNIT PAS DE CONSEILS NI DE TRAITEMENTS MÉDICAUX. Les fréquences sonores et le contenu fournis par l’Application sont destinés uniquement à la relaxation et au bien-être général. Ils ne sont pas destinés à diagnostiquer, traiter, guérir ou prévenir une maladie. Ils ne remplacent pas un diagnostic, un conseil ou un traitement médical. En cas de problèmes de santé, consultez un professionnel qualifié. En cas d’inconfort, cessez immédiatement l’utilisation.
ZirbelSignal stocke toutes les données exclusivement en local sur votre appareil. Il n’y a pas de synchronisation cloud, pas de suivi et pas d’analyse. L’Application n’a pas accès aux données de paiement.

DANS LA MESURE MAXIMALE AUTORISÉE PAR LA LOI, LE DÉVELOPPEUR N’EST PAS RESPONSABLE DES DOMMAGES INDIRECTS, ACCESSOIRES, SPÉCIAUX OU CONSÉCUTIFS. LA RESPONSABILITÉ TOTALE NE DÉPASSERA PAS LE MONTANT PAYÉ DANS LES DOUZE (12) MOIS PRÉCÉDANT LA RÉCLAMATION.
Le Développeur peut fournir des mises à jour et du support à sa seule discrétion. Apple n’a aucune obligation de maintenance ou de support.
Le Développeur, et non Apple, est responsable de toute réclamation relative à l’Application.
En cas de réclamation d’un tiers pour violation de propriété intellectuelle, le Développeur, et non Apple, en est seul responsable.
Apple et ses filiales sont des tiers bénéficiaires de ce Contrat. Apple a le droit de faire appliquer ce Contrat contre vous.
Vous déclarez ne pas vous trouver dans un pays sous embargo américain et ne pas figurer sur une liste de personnes interdites.
Ce Contrat est régi par le droit allemand. Tribunal compétent : Karlsruhe, Allemagne. Pour les consommateurs de l’UE, les lois de protection des consommateurs de votre pays de résidence s’appliquent si elles offrent une protection supérieure.
Le Développeur se réserve le droit de modifier ce Contrat. Les modifications prennent effet dès leur publication. L’utilisation continue vaut acceptation.
Si une disposition est jugée invalide, les autres restent en vigueur.

Este Acuerdo de licencia de usuario final (« Acuerdo ») es un contrato legal entre usted (« Usuario ») y Daniel Ovadia (« Desarrollador », « nosotros ») para el uso de la aplicación móvil ZirbelSignal (« Aplicación »).
Al descargar, instalar o utilizar la Aplicación, usted acepta este Acuerdo. Si no está de acuerdo, no utilice la Aplicación.
Este Acuerdo es exclusivamente entre usted y el Desarrollador, no con Apple Inc. (« Apple »). El Desarrollador, no Apple, es el único responsable de la Aplicación y su contenido.
El Desarrollador le otorga una licencia limitada, no exclusiva, no transferible y revocable para usar la Aplicación en cualquier dispositivo Apple que posea o controle, según los Términos y Condiciones de los Servicios Multimedia de Apple.
La Aplicación ofrece una suscripción mensual opcional con renovación automática (« ZirbelSignal Premium ») que proporciona acceso ilimitado a todas las funciones y contenidos.

No están destinados a diagnosticar, tratar, curar o prevenir ninguna enfermedad. No sustituyen el diagnóstico, consejo o tratamiento médico. Si tiene problemas de salud, consulte a un profesional cualificado. Si experimenta molestias, deje de usar la Aplicación inmediatamente.
ZirbelSignal almacena todos los datos exclusivamente en local. Sin sincronización en la nube, sin seguimiento, sin análisis. La Aplicación no tiene acceso a datos de pago.

EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, EL DESARROLLADOR NO SERÁ RESPONSABLE POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES O CONSECUENTES. LA RESPONSABILIDAD TOTAL NO EXCEDERÁ EL MONTO PAGADO EN LOS DOCE (12) MESES ANTERIORES A LA RECLAMACIÓN.
El Desarrollador puede proporcionar actualizaciones y soporte a su discreción. Apple no tiene obligación de mantenimiento o soporte.
El Desarrollador, no Apple, es responsable de todas las reclamaciones relacionadas con la Aplicación.
En caso de reclamación de un tercero por violación de propiedad intelectual, el Desarrollador, no Apple, es el único responsable.
Apple y sus filiales son terceros beneficiarios de este Acuerdo. Apple tiene el derecho de hacer cumplir este Acuerdo contra usted.
Usted declara no encontrarse en un país bajo embargo estadounidense ni figurar en una lista de personas prohibidas.
Este Acuerdo se rige por el derecho alemán. Jurisdicción: Karlsruhe, Alemania. Para consumidores de la UE, se aplican las leyes de protección al consumidor de su país si ofrecen mayor protección.
El Desarrollador se reserva el derecho de modificar este Acuerdo. Los cambios surten efecto tras su publicación. El uso continuado implica aceptación.
Si alguna disposición es inválida, las demás permanecen vigentes.

Questo Contratto è concluso esclusivamente tra voi e lo Sviluppatore, non con Apple Inc. (« Apple »). Lo Sviluppatore, non Apple, è l’unico responsabile dell’App e del suo contenuto.
Lo Sviluppatore vi concede una licenza limitata, non esclusiva, non trasferibile e revocabile per utilizzare l’App su qualsiasi dispositivo Apple di vostra proprietà o controllo, secondo i Termini e Condizioni dei Servizi Multimediali Apple.
L’App offre un abbonamento mensile opzionale a rinnovo automatico (« ZirbelSignal Premium ») che fornisce accesso illimitato a tutte le funzionalità e i contenuti.
L’App offre un numero limitato di sessioni gratuite prima che sia richiesto un abbonamento Premium. Lo Sviluppatore si riserva il diritto di modificare il numero di sessioni gratuite in qualsiasi momento.
ZirbelSignal genera frequenze sonore e offre contenuti di benessere e rilassamento:
L’APP NON FORNISCE CONSULENZA NÉ TRATTAMENTO MEDICO. Le frequenze sonore e i contenuti forniti dall’App sono destinati esclusivamente al rilassamento e al benessere generale. Non sono destinati a diagnosticare, trattare, curare o prevenire malattie. Non sostituiscono diagnosi, consulenza o trattamento medico. In caso di problemi di salute, consultate un professionista qualificato. In caso di disagio, interrompete immediatamente l’uso.
ZirbelSignal memorizza tutti i dati esclusivamente in locale sul vostro dispositivo. Nessuna sincronizzazione cloud, nessun tracciamento, nessuna analisi. L’App non ha accesso ai dati di pagamento.

L’APP È FORNITA « COSÌ COM’È » SENZA GARANZIE DI ALCUN TIPO. NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE, LO SVILUPPATORE ESCLUDE TUTTE LE GARANZIE.
NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE, LO SVILUPPATORE NON SARÀ RESPONSABILE PER DANNI INDIRETTI, INCIDENTALI, SPECIALI O CONSEQUENZIALI. LA RESPONSABILITÀ TOTALE NON SUPERERÀ L’IMPORTO PAGATO NEI DODICI (12) MESI PRECEDENTI IL RECLAMO.
Lo Sviluppatore può fornire aggiornamenti e supporto a propria discrezione. Apple non ha obblighi di manutenzione o supporto.
Lo Sviluppatore, non Apple, è responsabile di tutti i reclami relativi all’App.
In caso di reclamo di terzi per violazione di proprietà intellettuale, lo Sviluppatore, non Apple, ne è l’unico responsabile.
Apple e le sue filiali sono terzi beneficiari di questo Contratto. Apple ha il diritto di far valere questo Contratto nei vostri confronti.
Dichiarate di non trovarvi in un paese sotto embargo statunitense e di non figurare in alcuna lista di persone vietate.
Questo Contratto è regolato dal diritto tedesco. Foro competente: Karlsruhe, Germania. Per i consumatori dell’UE, si applicano le leggi di protezione dei consumatori del vostro paese se offrono maggiore protezione.
Lo Sviluppatore si riserva il diritto di modificare questo Contratto. Le modifiche hanno effetto dalla pubblicazione. L’uso continuato equivale ad accettazione.
Se una disposizione è ritenuta invalida, le altre rimangono in vigore.
